The short version

- Any agreement between a composer and a library is between them. Betty Sky isn't a party to it.
- Use the service lawfully and only upload what you have the right to upload.
- We work hard to keep Betty Sky running, but it's provided as it is. Keep your own copies of anything important.

1. About these terms
These terms apply to your use of bettysky.com and app.bettysky.com, including the Betty production desk and the Miss Sky composer portal (together, Betty Sky or the service). Betty Sky is run by Purplelf Limited, registered in England and Wales (company number 11251864), registered office Mill Lane House, Mill Lane, Margate, CT9 1LB ("we", "us", "our").
By creating an account, accepting an invitation, or using the service, you agree to these terms. If you're using Betty Sky for a company (for example, a library, publisher or label), you confirm you're authorised to accept these terms for it, and "you" includes that company. If a library has signed a separate written agreement with us, that agreement takes priority where it differs from these terms.
2. The service
Betty Sky helps music libraries, publishers and labels (libraries) run their releases: albums and their production stages, submissions, writers, pseudonyms and splits, delivery paperwork such as CATI and Harvest sheets, and draft composer agreements. Miss Sky lets composers invited by a library send music, deliver files, confirm their details, follow progress and message the library.
Betty Sky is a tool. It doesn't give legal, tax or royalty advice. Documents it prepares, such as draft contracts and delivery sheets, are based on the information you enter and your own templates, so check them before you rely on them or send them out.
3. Accounts and who can use Betty Sky
- You must be 18 or over and use Betty Sky for your work in music.
- Library accounts are set up by us or by a library's administrator. Composers join Miss Sky by invitation from a library.
- Keep your sign-in details and sign-in links private, and tell us straight away at hello@bettysky.com if you think someone else has used your account. You're responsible for activity under your account.
- Keep your details accurate, especially those used on agreements and royalty paperwork, such as your legal name, postal address, collecting society and IPI numbers.
4. Your music and content
You own your work. Using Betty Sky doesn't transfer any copyright or other rights in your music, recordings, stems, lyrics, artwork, metadata or documents (your content) to us.
So that we can run the service, you give us a limited, non-exclusive, royalty-free permission to store, copy, process, display and transmit your content, only as needed to provide Betty Sky to you and to the people you or your library choose to share it with. For example, this lets us play a track in the browser, show a file to the library you sent it to, or put a title into a delivery sheet. This permission ends when your content is removed from the service, except for copies kept for a limited time in backups.
No AI training. We don't use your content to train artificial intelligence models, and we don't allow our service providers to. We won't sell or license your content to anyone.
You confirm you have the rights and permissions needed to upload and share your content (including any samples, co-writers' shares and performers' consents), and that uploading it doesn't break the law or anyone else's rights.
If you send us ideas or feedback about Betty Sky, we may use them to improve the service without owing you anything. This doesn't apply to your music or other content.
5. Libraries and composers
- Agreements are between you. Any publishing, recording or other agreement between a library and a composer is between them alone. Betty Sky isn't a party to it and isn't responsible for its terms, for whether a submission is accepted, or for royalty payments.
- Each library is separate. Libraries using Betty Sky (including Audio Wallpaper and Cratedigger) are independent businesses. Your relationship with each library is with that library.
- Library responsibilities. A library is responsible for the information it puts into Betty Sky about composers and others, including having a lawful basis to use it and telling those people how it's used. For that catalogue information we act as the library's processor, as explained in our Privacy Policy, and we'll sign a data processing agreement on request.
- What composers see. Composers only see their own work, plus anything a library or composer chooses to share on a project.
6. Connected storage and your files
Libraries connect their own cloud storage (such as Dropbox or Google Drive) to Betty Sky. Files stay in the library's own account, under the library's own agreement with that provider. With the library's permission, Betty Sky reads those folders, creates project folders, puts files that composers upload into the right place, and moves files that composers remove into a REMOVED folder rather than deleting them.
Betty Sky isn't a backup service. Libraries and composers should keep their own copies of important files. We aren't responsible for files changed or lost in a connected storage account by its owner, by the storage provider, or through events outside our reasonable control.
7. Acceptable use
Please don't:
- upload anything you don't have the right to share, or anything unlawful, harmful or infringing;
- try to access accounts, desks or information that aren't yours, or get around Betty Sky's security or access rules;
- copy, scrape, reverse-engineer or resell the service, or use automated tools to overload it;
- upload viruses or other harmful code; or
- use Betty Sky to harass, spam or mislead anyone.
8. Fees and payment
- Miss Sky is free for composers.
- Libraries' fees, if any, are agreed with us in writing (for example, by email or in an order). During early access, Betty Sky may be provided free of charge or at an introductory price.
- Before we start charging for something that's currently free, or change your price, we'll give you at least 30 days' notice. You can stop using the paid part before the change takes effect.
- Unless agreed otherwise, fees are in pounds sterling, exclude VAT, and are payable in advance for each billing period. Paid periods aren't refundable, except where the law requires or we agree.
9. Our intellectual property
We own Betty Sky: its software, design, names and logos (including "Betty Sky" and "Miss Sky"), and everything else we provide, except your content. While you have an account, you may use the service for its intended purpose under these terms. Nothing here gives you any other rights in it.
10. Availability and changes
Betty Sky is growing, and we're adding and improving features all the time. We'll do our best to keep it available and working well, but we can't promise it will always be uninterrupted or error-free. We may need to pause it for maintenance. We may change or remove features. If we remove something important that you pay for, we'll tell you in advance where we reasonably can.
11. Suspension and closing an account
- You can stop using Betty Sky at any time. Libraries can ask us to close their desk, and composers can ask a library or us to close their Miss Sky access.
- A library can stop a composer's Miss Sky access at any time.
- We may suspend or close an account if it breaks these terms, puts the service or others at risk, or if we must by law. Where it's reasonable, we'll warn you first and give you a chance to put things right.
- When a library's desk closes, we'll help it export its information if asked within 30 days. After that we delete or anonymise it as set out in our Privacy Policy. Files in a library's own connected storage stay there.
12. Our responsibility to you
- Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else the law doesn't allow us to limit. If you use Betty Sky as a consumer, nothing here affects your legal rights.
- Betty Sky is provided "as is". We don't promise it will meet every need, and we're not responsible for decisions made using the information in it, such as release dates, splits or royalty calculations.
- We aren't liable for loss of profits, revenue, business, goodwill or data, or for indirect or consequential loss.
- Our total liability to you in any 12-month period, for all claims, is limited to the greater of: the fees you paid us for Betty Sky in the 12 months before the claim, or £100.
- If you use Betty Sky for a business and break these terms (for example, by uploading content you don't have the rights to), you're responsible for the reasonable losses and costs this causes us.
13. Privacy
Our Privacy Policy explains how we handle personal information, including cookies. It forms part of these terms.
14. Changes to these terms
We may update these terms from time to time, and we'll change the date at the top. If a change is significant, we'll tell account holders by email or in the app at least 14 days before it takes effect, unless it's needed sooner for legal or security reasons. If you keep using Betty Sky after a change takes effect, you're accepting the new terms. If you don't agree, you can stop using the service.
15. General
- These terms (with any separate written agreement we have with your library, and our Privacy Policy) are the whole agreement between us about the service.
- If any part of these terms can't be enforced, the rest still applies.
- If we don't enforce something straight away, we can still enforce it later.
- We may transfer our rights and obligations to another company, for example if Betty Sky is sold. We'll make sure your rights aren't reduced. You may not transfer yours without our agreement.
- We aren't responsible for delays or failures caused by events outside our reasonable control.
- Nobody else has the right to enforce these terms under the Contracts (Rights of Third Parties) Act 1999.
16. Law and disputes
These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction. If you're a consumer living in Scotland or Northern Ireland, you can also bring proceedings in your local courts. If you have a complaint, please contact us first. Most problems can be sorted out quickly by talking.
